This Privacy & Terms ("Policy"), which governs your use of our website and mobile application (collectively, the "Services"), is provided by travelNew ("The Company" or "We" or “Platform”). You (“Users” or “Traveler”) accept this Privacy Policy (collectively, the "Agreement") by accessing or using our Services. If you disagree with the privacy policy, you cannot use the services. travelNew is a brand owned by Emerge Technology Business.

The Company may alter or amend these Policies at any time. We will send you a notification when we make changes to the Privacy Policy and post the updated versions of the policy on the platform. Once the updated policy goes into effect, you agree to the changes by continuing to use the Services.

To use services, you need to sign in using your social account or by providing your personal information. Login is required to save your data such as trips, connect with travelers and more. It also enables syncing your trips and data on the occasion of a handset change.

By using our platform, you voluntarily authorize the company to access and use certain account information, that you provide during registration, such as your email address, phone device, age, phone number and more.

We do our best to protect the personal information of our users, and your information is not shared with anyone, without your consent.

We do not guarantee the safety of the user's information as there is a possibility of a breach of security or unauthorized use of your mobile phone. The company is not liable for any loss or damage caused by any unauthorized use of your account.

You are responsible for always keeping your account credentials and other personal information secret. And you are solely responsible for all activities that occur under those credentials. If you find that someone has gained access to your account credentials, immediately you should change your login credentials.

The company reserve the right to terminate access to the platform permanently or temporarily, in case of any misuse is observed.

The company does not copy contact information from your mobile address book or copy any other details which are saved on your mobile.

The company will periodically access your account information to review, and see if someone has reported anything incorrect. We will also access your account information to study users' behaviour to improve our services over time. If you don’t log in to your account for 6 months, we may delete your account for inactivity.

The platform will collect and save your location data, your trip data and other data to provide more personalized trips and experiences.

You agree that the company may use your information across the company services.

The company use your account information for the following purposes: (i) to save your data, such as creating and maintaining your profile on our platform. (ii) to connect with you when you make your trip booking via email, SMS and any other means of communication (iii) to communicate with you about our new services that we believe may interest you, updates in the Privacy policy and terms of Services, offers such as discounts and promotions, exclusive offers, etc (iv) processing your request to join classy subscriptions, process your request, feedbacks, complaints and suggestions, (v) save your activities for review so that we enhance our services and develop new features and products from time to time. (vi) To keep you and other users safe in the platform by verifying the identity and (vii) preserve data and evidence to comply with applicable law to defend claims and protect users’ rights.

The company reserves the right, to monitor, screen, refuse, or remove any content you submit, if we find it inappropriate for other users and our services, or does not comply with the Terms of Services and Privacy policy, which are updated from time to time.

We might use your information to help fellow travelers and improve our services. You agree to your content being publicly available on the platform for an indefinite period without any compensation.

The company safeguards the users’ confidential credit/debit card information and other financial data. However, your data are also with the payment gateway partners and they are fully responsible for your personal data filled during the payment process. Privacy under their Privacy Policy which one might find on their website.

Usage of our information sent to your social accounts/third-party accounts is also governed by their data usage policies which one might find on their website.

When you disclose your data on the platform, you agree that you have voluntarily given access to your data to other users available on the platform.

When you save a trip on the platform, you agree that you have voluntarily given access to the platform about your trip data and provided permission to the platform to share your trip data with the travel advisors/partner to submit a quotation for your trip. Your contact details are shared with the travel advisors after the payment for the trip is completed.

Without your consent, we may disclose your data to law enforcement authorities to comply with a legal process or any other legal requirements.

We may transfer your data if we are in whole or in part, involved in a merger, sale, acquisition or other change of ownership or control.

You agree that the company reserves the right and without any obligations, can send push notifications and Emails to all the users of the platform at any time and for any number of times.

The company reserves the right to send push notifications and emails to inform the users about (i) any information, updates, reviews, feedback or anything about the platform and its services and (ii) any information, updates, reviews, feedback or anything about your account and the services you have availed.

Any feedback, suggestions or any other inputs you submit or post on the platform, you grant the platform the full ownership and intellectual property rights of that content, which includes the right to edit, adapt, or alter the content without requiring your attribution and send it as a push notification/and email to other users.

From our platform, you can edit and delete your account information and manage your preferences of what you want to show to other users at any time.

Through your mobile, you can withdraw consent that has been given to the platform to process your personal data for a specific purpose. When you withdraw consent, certain services may lose functionality.

You authorize the platform to take reasonable steps to verify your identity before granting access or making corrections for the safety of your and all other users’ account information.

To delete your account, you can email us (info@travelnew.in) the request and we’ll delete your data as laid out in this Privacy Policy. Till then the company maintain and interoperate your data at its own discretion. However, we shall keep limited data or complete data even after the deletion of your account to comply with applicable law to defend claims and protect users’ rights.

The time required to delete your account from our platform varies from user to user. The company at its discretion will process your account deletion request, till then your account will be visible on the platform.

Disclaimer

We have designed our services to match all. The platform is provided 'as is' and 'as available' for your use, which depends upon controllable and noncontrollable activities. The company does not offer any warranties of uninterrupted, timely, error-free service, and the company is not liable for any loss arising from your use of the Services directly or indirectly.

The information on the platform is taken from various sources such as the internet, travel professionals and others. The company does not warrant that results that may be obtained from the use of the service will be accurate or reliable or will always meet your specific trip or service requirements.

The company is not liable for compensation related to platform operational inefficiencies, misrepresentations, acts, omissions, errors, breaches of warranty, or operational inefficiencies or negligence on the part of any service or by any service provider of the company.

For whatever reason it may be, the company is not liable for any losses related to the job, business, occupation, lost relationships and/or friendship, contracts, business interruptions, or lost opportunities of the user while using the services.

Availability

The company will use all reasonable efforts to make the services available at all times. But, as the service is provided over the Internet and mobile networks and so the quality and availability of the services may be affected by external factors which are not in the company’s control.

You agree that the services can be unavailable or be interrupted for upgrades, repairs, network or equipment failures and other maintenance activities.

At the company’s discretion, the company may discontinue a part or all of our features or Services, including certain features and the support for certain devices and platforms, at any point in time. Events beyond our control may affect our Services, such as force majeure events

Platform and Travel Partners

You agree that the platform is meant to be used for personal travel requirements only, and not for commercial endeavours like arranging travel for other people, advertising and marketing products and services, or other similar activities.

The platform helps travelers create their trips and connect them with travel advisors that provide them with quotations for booking. Through travel advisors, traveler can make reservations and save money. The platform itself does not offer booking services. Both you and the travel advisors are responsible for reservations and payments made using the platform.

We go above to ensure that our travel advisors provide our all users with the greatest services possible. The platform does not guarantee the quality of services offered by its travel advisors. The Company will not be liable for any delays/deficiencies of any services provided by the travel advisors. The users shall be directly dealing with the travel advisors after payment is completed

The Company will always make every effort to protect the interests of all parties. In case of any issues, legal recourse lies with the specific travel advisors and not the company.

This platform is for people who love to travel and make new trip friends. We are not a site for finding love or fostering relationships. You agree that any relationship that is renounced as a result of the platform, is not the company's fault.

Eligibility

You are authorized to create an account in our platform or access/use the Service only if:

  1. You are 18 years of age or older.
  2. You are eligible to use the Service under the laws of India or any other applicable jurisdiction.
  3. You will comply with all applicable local, state, national and international laws, rules and regulations.
  4. You have never been convicted of any crime, and you are not registered as an offender with any state or local.
Communication on the platform

The company does not warrant of outcome you get due to any sort of communication done on the platform or content downloaded or accessed on the platform.

All information provided by the platform or by its representative, whether oral or written, does not create any warranty of accuracy. All users agree to exercise caution and take reasonable precautions in all interactions with other users, sending messages or feedback on the platform and interacting with any representative of the company.

The company does not verify the accuracy of user communications, due to privacy infringement. The company is not responsible for your communication and interactions with other users. You need to take all precautions and be responsible while communicating with other users.

The company is not responsible for content posted by you or other users or travel advisors. All the content posted is their own views and not the views or statements of the company.

The company does not accept any responsibility for any difficulty or inability to download or access content.

Users on the platform

The company is not obligated to conduct background checks on users or travel advisors and we can’t know each of our service users. The company does not warrant that you will find a compatible friend or travel advisor by using our services. You agree that your communication with other users or travel advisors, and making friends with known or unknown people is at your own risk.

The company encourages you to exercise caution and take necessary precautions when meeting travel advisors or other users offline. Before meeting trip friends and travel advisors, you agree to read our travel safety section in our applications and understand all risk factors associated with it.

Posting on the Platform

You are solely responsible for the appropriateness, legality and consequences of all content you submit. You agree that they will not post content (written or voice or video or images) which are: (i) prohibited, illegal, harmful, offensive, pornographic or unlawful (ii) Bullying, abusive, violent, threatening, or defamatory (iii) offensive or discriminatory comments about a person or group (iv) Racist, bigoted, hateful, or discriminatory (v) Personal information like phone numbers, addresses, or finances details (vi) False, fake, spam or misleading (vii) Promotes criminal activity (viii) Infringes on intellectual property rights of others (ix) advertise a product or event or business or conduct research, (x) to raise find, promote a political campaign, starts a contest (xi) hurting any religion sentiments or any religious beliefs (xii) violence on disability, gender, age, national/place origin, sexual orientation, or gender identity (xiii) advocates or glorifies suicide or self-harm (xiv) copyrighted or trademarked by others and (xv) on alcohol or drug use (xvi) Capitalizing on tragedy happened (xvii) Snarky, or sarcastic comments and (xviii) any content that you are not allowed to do so.

By submitting content on the platform, you grant its full ownership and intellectual property rights of that content to the company, which includes the right to republish, edit, adapt, or alter the content without requiring your attribution.

You agree that all content you post is your content and have the right to submit it and you are not using others' content or infringements.

We do not take any liability on content which is posted was not original content, was not previously published or contains third-party property.

You agree and acknowledge that the platform does not warrant responses or help or prompt and right responses during emergency situations and this platform is for trip planning and not an emergency helping platform.

Copyright and Browsing Licence

The Company grants you a personal, non-exclusive, non-transferable, revocable license to access and use the platform and its content for non-commercial purposes only.

By using our services you agree that you will not (i) Copy, modify, or reproduce any copyrighted material or any material on the platform. (ii) change a bit and try to hide the origin of information and (iii) Frame or make a mirror of any part of the service or platform content.

If you believe that content infringes on your copyright, please email us details of the infringing content and proof of your copyright ownership via email at reachtravelnew@gmail.com. The company will investigate and after that may remove the content at its discretion. False claims of copyright infringement will result in legal action against the claimant.

The company cannot guarantee a specific timeframe for resolving copyright claims.

Classic Subscription and refund norms

Classic is a paid service in the platform for accessing premium services as these services require a lot of resources to keep live. Due to changes in resources being used, the company at any time reserves the right to change subscription fees and service durations.

You agree that the company does not guarantee the number or quality of trip friends or trips encountered during the subscription period and you have chosen the classy subscription voluntarily.

You agree that no refunds will be issued to the user for breaches of the terms mentioned in this agreement, violating any state or social rules and regulations and for being reported as incorrect by other users.

Classic subscription fees are very nominal for a month's subscription and resources that are required to process those returns are more costly, thus you acknowledge that the company reserves the right to refuse to refund on cancellation of subscriptions, however, the users continue to avail of services till the validity of the plan.

For any Subscriptions which are cancelled when 2 months or more validity is left, the refunds are initiated on a Prorata basis minus the transaction charges and minus applicable GST, and the balance is refunded.

Existing subscribed users will not be subject to new pricing changes unless they resubscribe after cancellations and after the validity of subscriptions.

All payment processes are handled by a third-party application and their own refund Terms and Conditions will be applicable along with the platform’s Terms and Conditions

Trip and Booking

All travel and trip details in the platform are estimated and cannot be 100% accurate due to external, travel, climate and any other reasons. The company is not obligated to conduct rechecks on trips that are published on the platform and the company does not warrant 100% accuracy of the trip published. You agree that you will verify all details and external parameters before making any decision and payment.

Trip itineraries are based on information available at the time of publishing and booking. This may change due to unforeseen circumstances, fairs, festivals, weather conditions, etc. Hence, the company and the travel advisor reserve the right to modify the itinerary or skip sightseeing before or during the trip is live. The company and the travel advisor are not liable for any damages, additional expenses, or losses, or to compensate, resulting from any such changes.

The company doesn't provide booking services, but acts as a support for users to book their trips. After the trip is saved, the platform suggests to users our travel advisors, which include but are not limited to Hotels, Amusement parks, Tourist guides, Restaurants, Retail Shopping centres and more. We collect booking requests and might forward them to partnered travel advisors. While the company continuously strive for accuracy, it does not guarantee the timeliness, quotations offered, reliability, or completeness of information of the travel advisors. All trip quotes are subject to change before the trip payment is completed. As these changes are made by travel advisors, you agree not to hold the company liable for such changes.

Payment for the trip indicates your agreement to enter a contract between you and your travel advisor and not between you and travelNew.

You agree that you will not do the trip booking for others, and if the booking is done for others, you are responsible for any incorrect information shared and resulting losses. The company/travel advisors may cancel bookings if misleading or wrong information is shared and penalise any payments that were made.

The company and the travel advisor are not responsible or held liable for missed sightseeing or services due to traveler’s delays or time constraint.

Cancellation Policy and Refund

We follow a normal practice of the industry i.e. changes within 48 hours of the start of the trip cannot be guaranteed, even if there is availability. If changes cannot be accommodated, there will NOT be any refund.

The company reserves platform fees for the services it provides and the cost for transactions to either you as a refund or the travel advisor as payment for arrangements of the trip.

You agree that failure to make timely payments or complete payment may result in booking cancellation and forfeiture of any payments already made.

You agree that all Cancellation requests must be submitted through the trip quote page in the platform. Requests sent by email will not be entertained. Also, all cancellations cannot be reinstated, until your process is verified and the booking id is provided. Trips get deleted from the users’ accounts once the payment is refunded.

The cancellation date is the date on which the request is submitted and is calculated accordingly.

The company or the travel advisor is not obligated to provide any expenses of the trip if the cancellation date has lapsed or the trip has already started.

The company is not liable for refunding interest on the amount paid, during any refund or after settlement. Also, the company is not liable for any additional expenses related to other arrangements or services booked by you for the trip which was cancelled.

You agree that if you cancel/change a tour, and we have incurred expenses which we can’t recoup, then you will have to pay for these expenses.

Refunds are made to the users as per the refund rates and timelines laid by our travel advisor, whose quote was selected by you. Hence, you agree that it is your responsibility to read and understand the refund policy of the travel advisor, which is provided with every quotation for your trip, before you make the payments. If you have not received the refund policy, you agree that you will ask for the same and read and understand it before any payment to travel advisors.

We do not have any concrete answers to your refund-related queries as the responses need to be from the travel advisors and the payments are made direcly to them. We will just try to solve your queries, and our responses are not final and do not guarantee that we will solve your queries. For all refund-related queries, users can email with booking ID, travel advisors and contact number through our connect page. We are not bound by any timelines; however, we will try and ensure that all emails are replied to within 48 hours.

Unforeseen Circumstances/ Operator Cancellations

Certain trips may be weather-dependent, or be vulnerable due to unforeseen circumstances and travel advisors may cancel the trips for safety and various other reasons. The users need to be continuously connected with the travel advisors till the trip is completed. They shall notify you before the tour starts if they have to cancel due to Unforeseen Circumstances/ Operator Cancellations.

Users conduct

By using the Service, you agree that you will not (i) use the service for purposes that are prohibited by this agreement and as updated from time to time (ii) use the service for purposes that are illegal and do not comply with all laws, rules, regulations, and tax obligations at the users’ destination. (iii) to damage the image of the company or any other users or trip advisors (iv) ask for money or to cheat any other users (v) have multiple accounts, make-believe others that you are someone else, impersonate, or otherwise misrepresent affiliation, connection or association with, any person or entity. (vi) use the Services for any commercial or other purposes that are not expressly permitted by this agreement (vii) infringe the rights, intellectual property and privacy of any person or entity (viii) harass any other user of the platform (ix) offer, as an Operator and contact users for trip booking or use the platform to promote business (x) act yourself or otherwise solicit any user to join third party services or websites that are competitive to the company (xi) ask password or any personal information from other users or use other users’ information without his or her permission (xii) create another account if we have already terminated your account for misconduct. (xiii) use automated tools (scrapers, crawlers, bots) to access the platform’s digital pages (xiv) Copying, storing, or accessing information without authorization or permission and (xv) Interfere platform’s service through malware, viruses or other harmful code

The company reserves the right to investigate and find any user regards as inappropriate or unlawful, including actions or communications that occur on or off the Service. The company also reserves the right to cancel such offending user's account without a refund of any purchase, permanently block such member from access to the Service, and take any legal action to the fullest extent of the law. There will be no do-overs of the account once the account is terminated.

Reporting misconduct and sharing feedback

You reserve the right to report other users with incorrect information on the platform, problematic travel advisors, inappropriate behaviour of trip friends, and activities of the users that violate the policies mentioned in this agreement.

The company encourages and welcomes users to provide feedback and suggest improvements to the Services. You agree that all feedback and suggestions submitted will become the company’s exclusive property.

The company follows a zero-tolerance policy for fake or false feedback, suggestions, and reporting misconduct.

Obligations of the Traveler

There are obligations for you, which are required for the security of all, the happiness of tourists, safeguarding the business of trip advisors and enhancing the quality of tourism services. You agree to (i) pay the full trip cost within the set deadlines. (ii) adhere to the trip destination laws and regulations (iii) read, understand, accept and follow the terms and conditions and payment policies set by the chosen trip operator. (iv) show original documents as and when required during the trip (v) should not continue or attend the trip if you and other members are not in good physical and mental health or if a traveler is at any stage of pregnancy (vi) ensure that always a guardian should accompany minors and someone who requires attention and assistance during the trip (vii) will not carry alcohol, drugs, illegal or restricted items such as any type weapons, inflammable or explosives. (viii) follow travel advisor guidelines and adhere to the laid timeline always (ix) will not hold responsible travel advisors or the company or fellow travelers for any expenses or penalties incurred due to your negligence during the trip. (x) accept that the participation is voluntary and acknowledges inherent risks associated with the trip (xi) not add a member(s) for the trip or during the trip (xii) carry enough money for trip out-of-the-pocket expenses and for unforeseen circumstances. (xiii) not harass or stalk other travelers, locals or anyone (xiv) follow all norms of the tourist spots, imposed by the local or state or the owner of the property such as religious place, museums, etc. (xv) respectfully behave with travel advisors and fellow travelers (xiv) will not indulge in argument, fight or violence with anyone during the trip (xv) accept the available and assigned Seat for flights, vehicles, and trains. Also, accept the trip vehicle as it might be chosen as per the location, no. of travelers, and availability (xvi) accept the room allocated and quality of services by the hotel management as the travel advisor cannot do everything to improve (xvii) not use the trip vehicle for personal use (xviii) treat drivers with respect and comply with local traffic regulations (xix) will not smoke, consume alcohol, or eat inside the vehicle (xx) will not damage the vehicle, local property and compensate immediately if done so (xxi) will not hold responsible to the driver, travel advisor and tourist guide for missed sightseeing due to unforeseen circumstances such as traffic, vehicle breakdown, climate conditions, etc. (xxii) pay all out-of-pocket expenses such as refundable advance to the hotel, sightseeing charges such as museum entry fees or any such cost/fees which are not included in the booking and (xxiii) read and understand the information in travel safe page on our platform.

You agree that a notarized consent letter from the absent parent is mandatory if minors are travelling without their parents and a consent letter from a guardian is mandatory if a disabled or elderly person is travelling without their guardians.

Obligations of the Trip Advisors

There are obligations for trip advisors, which are required for the security of all, the happiness of tourists, safeguarding the business of trip advisors and enhancing the quality of tourism services. You agree that the obligations of trip advisors are to (i) investigate and collect information before the trip gets started (ii) warn and disclose known negative information that's not "obvious or apparent" to the traveler (iii) understand the traveler requirements, explain the itinerary and trip timeline and assist all the traveler in all possible ways to ensure the trip goes as smoothly as possible (iv) do the booking, reservations and inform reservations to traveler (v) disclose the identity of tourist guide before the trip is started (vi) respectfully behave with travelers (vii) remind tourist every time to reach in time to trip vehicle, railway station, airport or any places which are required to adhere the trip timeline. (viii) tourist guide and driver to be in good physical and mental health (ix) tourist guide and driver not to carry alcohol, drugs, illegal or restricted items such as any type weapons, inflammable or explosives (x) not add a member(s) during the trip (xi) do not hold responsible travelers or the company for any expenses or penalties incurred due to tourist guide and driver negligence during the trip (xii) tourist guide and driver should not harass or stalk to travelers, locals or anyone (xiii) tourist guide and driver should not indulge in argument, fight or violence with anyone during the trip (xiv) tourist guide and driver should not smoke, consume alcohol, or eat inside the vehicle and (xv) encourages hospitality

Rights and liability of the Trip advisors

There are rights for trip advisors, which are required for the security of all, the happiness of tourists, safeguarding the business of trip advisors and enhancing the quality of tourism services. You agree that travel advisors have the right to (i) withdraw or revise a quote if you fail to make timely payments. (ii) change the transportation service or substitute a hotel of an equal or higher category (iii) ask for additional and advance payment if you ask for itinerary modifications or for upgradation in services. (iv) to terminate a traveler's or all members’ trip participation even during the trip for failure to comply with tour decorum.

Trip advisors or a tourist guide(s) are not liable for (i) Theft, loss, or damage to your personal belongings or of any traveler. (ii) Injuries or accidents due to traveler’s negligence while on the trip (iii) Accompanying traveler(s) personally or staying with them in emergencies (iv) Recovering lost items of travelers. (v) make payment on behalf of traveler (vi) bear any loss that occurred or any consequences that happened due to unforeseen circumstances. (vii) Disruptions of hotel’s service and (viii) Inconvenience associated with accommodations in natural settings (tents, camps, etc.), such as insects bite.
